These Terms of Service (“Terms”) govern your purchase, download, use, and access to the ProfileSwitch WordPress plugin (“Plugin”), including any associated downloads, automatic updates, and support services provided by David Parker (“I”, “me”, or “Developer”).
By purchasing, downloading, installing, or using the Plugin, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Plugin.
1. License and GPL Compatibility
The Plugin is licensed under the GNU General Public License version 2 or later (GPLv2 or later), which is fully compatible with WordPress. A copy of the GPL can be found at https://www.gnu.org/licenses/gpl-2.0.html.
You are granted a non-exclusive, non-transferable license to use the Plugin on websites according to the number of licenses included in your purchased plan. You may modify the Plugin’s code as permitted under the GPL.
The purchase of a license key entitles you to:
- Download the Plugin files
- Receive automatic updates for the current version only
- Access priority support for the current version only
The GPL allows you to freely use, modify, and redistribute the Plugin code. However, license keys for updates and support are provided only to paying customers and are non-transferable.
2. Purchase and Payment
Purchases are processed through secure payment providers. All fees are in USD (or as specified at purchase) and are non-refundable except as outlined in Section 3.
You are responsible for any taxes applicable to your purchase.
3. Refund Policy
I offer a 14-day no-questions-asked money-back guarantee.
If you are unsatisfied with the Plugin for any reason, you may request a full refund within 14 days of your original purchase date by contacting me at [email protected].
Refunds will be processed to your original payment method. After 14 days, all sales are final, and no refunds will be issued.
Renewals (if applicable) are not eligible for refunds under this guarantee.
4. Automatic Updates and Support
Active license holders receive automatic updates through the WordPress dashboard and priority email support for the current version of the Plugin only.
I do not provide updates or support for previous versions. Once a new version is released, support and updates are limited to that version.
Support is provided at my discretion and may include guidance on installation, usage, and troubleshooting for the current version. I do not guarantee resolution of issues caused by third-party themes, plugins, hosting environments, or custom modifications.
5. Warranty and Disclaimer
The Plugin is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
I do not warrant that the Plugin will meet your requirements, operate without interruption, or be error-free. Use of the Plugin is at your own risk.
Compatibility with future versions of WordPress or third-party software is not guaranteed.
6. Limitation of Liability
To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Plugin.
My total liability shall not exceed the amount you paid for the Plugin.
7. Termination
I reserve the right to terminate your license, access to updates, support, or downloads at any time, for any reason, with or without notice. This includes, but is not limited to, violations of these Terms, abusive behavior, or non-payment.
Upon termination, you may continue to use the Plugin under the GPL, but you will lose access to updates, support, and future downloads from my site.
You may terminate your use at any time by ceasing to use the Plugin and deleting all copies.
8. Intellectual Property
The Plugin’s source code is copyrighted by David Parker and licensed under the GPL. All rights not expressly granted under the GPL are reserved.
Trademarks, logos, and branding associated with ProfileSwitch remain my property.
9. Changes to These Terms
I may update these Terms at any time. Continued use of the Plugin after changes constitutes acceptance of the new Terms. Significant changes will be notified via email or on my website.
10. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
